What are my rights to claim insurance? Are there any consumer protection against companies who abuse the consumer? The answer is yes! Each entity has the administration of the State which regulates insurance companies.
1945 McCarran-Ferguson Act codified in federal law, U.S. Code Title 15, Chapter 20 gives states the power to regulate the activity of insurance as they see fit. This is the reason that all policies and regulations are different in each state. All states have enacted laws that apply to insurance companies, agents, brokers, adjusters, and just as all other that has nothing to do with the business.
These laws empower the states to create the "Department of Insurance." Also codify the rights of complaint a consumer has against an insurance company. For example, the Revised Code of Washington (RCW) 48.01.030 states that "The insurance business is one affected by public policy, which requires that all persons be actuated by good faith, abstain from deception, and practice honesty and fairness in all insurance matters. For the insurer, the insured, their suppliers and their representatives rests the duty to preserve intact the integrity of insurance. "This language is common all states with little modification.
This language is very specific and sets out the requirement of good faith and fair dealing. Most states define exactly what their consumer rights or say what practices are prohibited.
- Misrepresent pertinent facts or provisions insurance policy;
- Failure to recognize and act with reasonable promptness in communications with respect to claims arising from insurance policies;
- Failing to adopt and implement reasonable standards for prompt investigation of claims arising under insurance policies;
- Refusing to pay claims without conducting a reasonable investigation;
- Failing to affirm or deny coverage of claims within a reasonable time after the state test losses have been completed;
- Not trying in good faith to make quick settlements, fair and equitable resolution of claims in which liability has become quite clear. In particular this includes the obligation to make payment system claims to property damage to innocent third parties in clear liability situations. If there are two or more insurance companies that must make arrangements to make such payment, leaving to themselves the burden sharing of it;
- Requiring the insured to establish or submit to litigation, arbitration or appraisal to recover amounts due under an insurance policy by offering substantially less than the amounts ultimately recovered in actions or proceedings;
- The attempt to resolve a claim for less than the amount to which a man reasonably have believed he was entitled by reference to written or printed material or advertising that accompanies being part of an application;
- Make payments of claims to policyholders or beneficiaries not accompanied by a statement of coverage under which payments are being made;
- Affirming that policyholders or claimants a policy of appealing from arbitration awards in favor of the insured or claimants in order to force them to accept agreements or commitments unless the amount awarded in arbitration;
- The delay in the investigation or payment of funds required insurance, plaintiff, or doctor of anyone presenting a preliminary report and then claim that require subsequent communications containing substantially the same information;
- Failing to meet promptly with the claims, where liability has become reasonably clear, under one portion of the coverage of the insurance policy in order to influence settlements elsewhere coverage of the insurance policy;
- Failure to promptly provide a reasonable explanation of the basis in the insurance policy in relation to the facts or applicable law for denial of a claim or the offer of a compromise;
- Discriminate unfairly against claimants, as represented by a public adjuster;
- Failure to promptly honor projects included in the settlement of claims. A failure to honor a draft within three days working in the notification of receipt by the paying bank will constitute a violation of this provision. Dishonor of any such project for valid reasons related to the settlement of the claim do not constitute a violation of this provision;
- The failure to adopt and implement reasonable standards for processing and payment of claims once the obligation to pay has been established. With the exception of cases where time to pay is governed by law or regulation or set to a relevant contract, the procedures are not designed to deliver a check or money order payable to the beneficiary in the payment of claims settled within fifteen working days following receipt by the insurer or its attorney for the proper performance press or other settlement documents are not acceptable. An insurer is required to provide a suitable version or the document according to an insured or claimant, it must do so within twenty days after an agreement has been reached;
- Deferring assessments or adding to their costs under provisions for evaluating insurance policies through the use of appraisers from outside the area of loss. The use of appraisers from outside the area of loss of action only when the unique nature of the loss or lack of competent local experts make use of experts outside the area required.
